1. Introduction

Welcome to Probalist ("we," "us," or "our"). These Terms & Conditions govern your access to and use of our website at https://www.probalist.com and our TradingView indicator suite (collectively, the "Services").

By accessing, browsing, registering, or engaging in any transaction through our Services, you willingly acknowledge, accept, and agree to be bound by these Terms. You confirm that you possess the legal authority to enter into this agreement. If you do not agree, do not access or use our Services.

In addition to these Terms, you are also bound by our Privacy Policy. By agreeing to these Terms, you also consent to the data practices described there. We reserve the right to modify these Terms at any time. Continued use of our Services after changes are posted constitutes your acceptance.

2. Description of Services

Probalist provides a suite of professional TradingView indicators including buy/sell signal tools, order block detection, liquidity zone visualisation, pattern recognition, and real-time alert functionality. All indicators are delivered exclusively through the TradingView platform as invite-only scripts.

After subscribing, your TradingView username will be granted access to the relevant indicators, which will appear in your TradingView Invite-Only Scripts tab. Occasionally we may collaborate with affiliates or influencers to offer exclusive bonuses or promotions. The same Terms apply regardless of the subscription model or promotional offer chosen.

3. Subscriptions & Renewals

All Probalist subscriptions work on an auto-renewal basis. Your subscription will automatically renew at the end of each billing cycle (monthly or yearly) unless cancelled beforehand.

You may cancel your subscription at any time by contacting us at support@probalist.com. Upon cancellation your subscription will be set to non-renewal. You will retain full access to all products and features until the end of your current paid billing period. No charges will be applied after your current plan expires.

4. Payment Terms

Payments are processed securely through Stripe. We do not store your card details. By subscribing you agree to the following:

• Monthly and yearly billing cycles are available. Payments are charged in advance at the start of each cycle.
• Prices are displayed in EUR and may be subject to applicable local taxes.
• Subscriptions renew automatically unless cancelled before the renewal date.
• For payment queries or invoice requests, contact support@probalist.com.

5. Free Trial

All new subscribers are eligible for a 7-day free trial on any plan. No credit card charge will occur during the trial period. You may cancel at any time before the trial ends without being charged. Only one free trial per user is permitted.

6. Cancellation & Refunds

You may cancel your subscription at any time by contacting us at support@probalist.com. Upon cancellation you will retain access until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

In exceptional circumstances, refund requests may be considered at our sole discretion. To request a refund, contact us within 7 days of your most recent charge with your order details.

7. Discount Codes & Promotions

Discount codes are valid for new subscriptions only and apply to the first invoice of the chosen billing cycle. One code per account. Codes cannot be combined with other offers, have no cash value, and expire as stated at the time of issue.

8. Acceptable Use

By using our Services you agree not to:

• Share, resell, or redistribute access to Probalist indicators to third parties.
• Reverse engineer, copy, or replicate our indicators or scripts.
• Use our Services for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to our systems or another user's account.
• Use automated tools to scrape or extract data from our Services.
• Misrepresent yourself or impersonate another person or entity.

Violation of these terms may result in immediate termination of your subscription without refund.

9. Intellectual Property

All content, indicators, scripts, designs, and materials available through Probalist are our intellectual property and are protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the indicators solely for your personal trading activities. Nothing in these Terms grants you ownership of any Probalist intellectual property.

10. Disclaimer of Financial Advice

Probalist indicators are tools designed to assist with technical analysis. They do not constitute financial advice, investment recommendations, or solicitations to buy or sell any financial instrument. Past performance of any signal or indicator does not guarantee future results.

You acknowledge that trading financial markets involves substantial risk of loss and may not be suitable for all investors. Probalist and its team are not responsible for any trading losses incurred through the use of our Services.

11. Third-Party Services

Our Services integrate with the following third-party platforms:

• TradingView — Our indicators are hosted and delivered via TradingView. Use of TradingView is subject to their own Terms of Service.
• Stripe — All payments are processed by Stripe. Their privacy policy and terms apply to all payment transactions.
• Anthropic — Our AI chat is powered by Anthropic's Claude API, subject to Anthropic's usage policies.
• Google Translate — Used to provide multilingual support, subject to Google's Terms of Service.

We are not responsible for the availability, accuracy, or practices of these third-party services.

12. Limitation of Liability

To the fullest extent permitted by law, Probalist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to trading losses, loss of data, or loss of profits.

Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 30 days preceding the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice on our website. The date at the top of this page reflects the most recent update. Continued use of the Services after changes constitutes acceptance of the updated Terms.
